By downloading, installing, or using CopeCount ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

Description of Service

CopeCount is a macOS menu bar application that displays cryptocurrency portfolio values and profit/loss calculations. The App fetches price data from third-party APIs and performs calculations based on user-entered holdings.

No Financial Advice

The App is provided for informational purposes only. Nothing in the App constitutes financial, investment, legal, or tax advice. You should consult a qualified professional before making any financial decisions.

We are not a financial advisor, broker, or fiduciary. Use of the App does not create any such relationship.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• Price data or calculations will be accurate, complete, or current
• Any errors in the App will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COPECOUNT (THE COMPANY) OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any errors, inaccuracies, or omissions in price data or calculations
• Financial decisions made based on information displayed in the App
• Unauthorized access to or alteration of your data

Third-Party Services

The App relies on third-party APIs (such as CoinGecko) for price data. We are not responsible for the availability, accuracy, or reliability of these services. Third-party services are subject to their own terms and privacy policies.

User Responsibilities

You are solely responsible for:

• The accuracy of the holdings and cost basis data you enter
• Verifying calculations against other sources before making decisions
• Maintaining backups of your data
• Complying with applicable laws and regulations

Modifications

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania. Any disputes arising from these Terms or use of the App shall be resolved in the courts of Vilnius, Lithuania.
